Pennsylvania Drivers Arrested in New JerseyIf you have never been convicted for a DUI or DWI anywhere, and if you are convicted in New Jersey of a DWI, Pennsylvania will NOT suspend your PA driving privileges for this first offense. The conviction will transfer into PA and it will be entered onto your Driver History. However, there will be no suspension for this first offense. Because it is on your driver history, you may be subject to insurance company surcharges. You must still consider aggressively defending the New Jersey DWI charge. If you work or travel in New Jersey, you will not be able to drive in NJ for the period of your suspension. NJ will not take away your PA license. It is still good everywhere else. NJ suspends your driving privileges in NJ only. If you need to drive in NJ, please call me to discuss your defense options. If you are convicted of a DWI in New Jersey, and if you have been convicted before for DUI in Pennsylvania, your license in PA will be suspended for a minimum of one year. The Motor Vehicle Commission in Trenton will forward notice of the conviction to the DOT in Harrisburg. In about 30-90 days, you will receive a suspension notice from DOT, stating that your PA driving privileges will be suspended as a result of the NJ conviction. A refusal conviction for an out of state driver in New Jersey will not result in any MVC surcharges.
